EXPLANATORY MEMORANDUM TO THE HEAD TEACHER’S REPORT TO PARENTS AND ADULT PUPILS (WALES) (AMENDMENT) REGULATIONS 2014

 

This Explanatory Memorandum has been prepared by the Department for Education and Skills and is laid before the National Assembly for Wales in conjunction with the above subordinate legislation and in accordance with Standing Order 27.1

DESCRIPTION

 

These Regulations make amendments to current Regulations to require head teachers to report the results of the assessments introduced by the National Curriculum (Assessment Arrangements for the Foundation Phase and the Second and Third key Stages) (Wales) Order 2014 to parents and adult pupils.

 

 

MATTERS OF SPECIAL INTEREST TO THE CONSTITUTIONAL AND LEGISLATIVE AFFAIRS COMMITTEE

 

There are no matters of special interest in relation to these Regulations.

 

 

LEGISLATIVE BACKGROUND

 

The Welsh Ministers’ power to prescribe the content of head teachers’ reports to parents is contained in section 408 of the Education Act 1996.  Those functions were conferred on the Secretary of State and were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999.  They are now vested in the Welsh Ministers by virtue of paragraph 30 of Schedule 11 to the Government of Wales Act 2006.

 

These Regulations are being made under the Negative Procedure

 

 

PURPOSE & INTENDED EFFECT OF THE LEGISLATION

 

These Regulations put in place a statutory duty on head teachers to report the results of the statutory assessments using the National Literacy and Numeracy Framework to parents and adult pupils as part of their annual report.

 

 

CONSULTATION

 

No consultation has been undertaken on these Regulations as they simply introduce consequential changes to legislation as a result of the assessment requirements introduced by the National Curriculum (Assessment Arrangements for the Foundation Phase and the Second and Third key Stages) (Wales) Order 2014.

 

 

REGULATORY IMPACT ASSESSMENT

 

A Regulatory Impact Assessment has not been produced for these Regulations as they make consequential changes as a result of the assessment requirements introduced by the National Curriculum (Assessment Arrangements for the Foundation Phase and the Second and Third key Stages) (Wales) Order 2014.
